Part of this behavior is due to the ban on the sale of tobacco products, which, according to some, affects the sale of lighters. Partially, the actions of sellers are influenced by the general poor training of personnel in matters of distribution - they simply do not know whether there is such a ban or not, and they try to play it safe.

What is not allowed to be sold to minors

Considering that a minor does not have the right to make any transactions without the permission of parents or people performing their duties, the main prohibitions prescribed in the legislation are addressed exclusively to retail. These prohibitions are established by many legislative acts, for example, such as The federal law dated February 23, 2013 No. 15, art. nineteen.

If you collect all the information on goods that cannot be sold to minors, then it can be summarized in a list that will include:

  • Alcoholic and low alcohol drinks.
  • Cigarettes, cigarettes and other tobacco products.
  • Until a certain age, you can not sell books that talk about sex education.
  • Products belonging to the category of pornographic.
  • Services of a sexual nature.

As you can see, there are no lighters and matches in the list. But they were there for quite a long time. This ban was introduced by letter number 1-314/32-9 issued by Roskomtorg. But since 2012, this document has been declared invalid, which means that any prohibitions imposed by it are removed. This includes a ban on the sale of matches and lighters to minors.

It is also worth noting that all such legislative acts are introduced for a reason, but due to the fact that the government is trying to protect underage citizens from harmful factors and goods.

Responsibility for the sale of prohibited goods to minors

The state monitors the distribution of alcoholic beverages very closely. This is due not only to the amount of counterfeit produced locally, but also to the harm that alcohol does to the human body. Especially if the conversation is about the child's body - it has not yet formed and is easily exposed to the destructive action of alcohol. It causes damage to many organs, greatly inhibits development, especially physical development, and leads to many consequences in adulthood. So in order to stop the sale of alcohol to minors, Art. 151.1 of the Criminal Code of the Russian Federation.

Under its influence, in the vast majority of cases, falls individual engaged in trade, that is, a direct seller sitting at the checkout. It is his responsibility to control the distribution of alcoholic beverages. And if such drinks get to minors, then this, most often, is precisely because of the actions of the employee.

And only when he made a direct order that violated the requirements for the distribution of alcoholic beverages. And his responsibility will be indirect, as an accomplice, because the order itself is not a direct violation - it will be considered only as an inciting factor. Alcohol is sold by employees working at the cash desk, which means they have every right to refuse a minor.

The punishment that law enforcement officials will impose on the seller under this article will be a fine. Its size can reach 80 thousand rubles. Also, the violator can be brought to a year of corrective labor and a ban on work in certain positions. Such a ban will be valid for up to three years. This penalty comes into force if it is proved that the offender sold alcoholic beverages to minors more than once, that is, repeatedly. If such an offense happens for the first time, then Part 2.1 of Art. 14.16 of the Code of Administrative Offenses of the Russian Federation.

Also, do not forget that the seller who refused to sell to a minor a product that is not prohibited for distribution can also be punished. For example, the aforementioned matches or lighters. This is stated in Article 426 of the Civil Code of the Russian Federation.

Responsibility for the purchase by minors of prohibited goods

It is worth noting that there are no legislative norms punishing a teenager for buying alcoholic beverages. There are only articles that impose a punishment on a person for drinking these drinks in places where it is forbidden to do so. But all responsibility and any penalties under such legislative acts will not be imposed on the minor, but on his parents or those who perform their duties. And such fines, repeated repeatedly, will be a reason for interest on the part of social services that control the fulfillment of their duties by parents.

A teenager can buy alcoholic beverages if he has gone through a procedure called emancipation. In this case, together with the passport, he presents the seller with the relevant documents stating that he is already capable. Then he can safely buy himself alcohol.
