REGULATIONS ON THE EXPERT COUNCIL
SELF-REGULATORY ORGANIZATION
"UNION" FEDERATION OF SPECIALISTS OF APPRAISERS "
(new edition)

1. GENERAL PROVISIONS

1.1. This Regulation on the Expert Council of the self-regulatory organization "Union" Federation of Appraisers Specialists "(hereinafter referred to as the Union) was developed in accordance with the Federal Law of July 29, 1998 No. 135-FZ "On appraisal activities in Russian Federation”(hereinafter referred to as the Law on Valuation Activities), other regulatory legal acts of the Russian Federation, the Charter of the Union and other internal documents of the Union.
1.2. This Regulation establishes the status, purpose of activity, competence and structure of the Expert Council of the Union (hereinafter referred to as the Expert Council).
1.3. The Expert Council is a body of a self-regulatory organization of appraisers, created to provide the function of carrying out the examination of reports on the appraisal of objects of appraisal (hereinafter referred to as the appraisal report).
1.4. The Expert Council in its activities is guided by the norms of the current legislation of the Russian Federation in the field of appraisal activities, including the Federal Law of July 29, 1998 No. 135-FZ “On Appraisal Activities in the Russian Federation”, Federal Appraisal Standards, regulations the authorized federal body exercising the functions of legal regulation of valuation activities, as well as internal normative documents Union.

2. COMPETENCE OF THE EXPERT COUNCIL

2.1. The competence of the Expert Council includes:
2.1.1. development of uniform requirements for the examination of assessment reports, working conditions for members of the Expert Council and their qualifications;
2.1.2. examination of assessment reports;
2.1.3. provision of consulting, methodological and other assistance to subjects of valuation activities, customers of valuation services and examination of valuation reports, as well as other persons;
2.1.4. other issues related to the activities of the Expert Council.
2.2. The procedure for the examination of evaluation reports is established in the standards and rules of the Union.
2.3. The Expert Council carries out its activities in cooperation with the Disciplinary Committee and the Control Department of the Union, as well as other bodies and structural divisions Union.

3. STRUCTURE AND PROCEDURE FOR FORMING THE EXPERT COUNCIL

3.1. Issues of formation of the Expert Council, early termination powers of the Expert Council or early termination, as well as the election of its individual members, are within the exclusive competence of the General Meeting of the Union Members.
The exclusive competence of the Council of the Union includes:
- approval of the Regulations on the Expert Council, amendments and additions to this Regulation;
- approval (establishment) of additional requirements for members of the Expert Council;
- performance general meeting members of the Union of candidates for election to the membership of the Expert Council of the Union;
- suspension of the activities of members of the Expert Council in the manner prescribed by the internal documents of the Union.
3.2. The Expert Council is formed from members of the Union in a quantitative composition of at least 7 (Seven) people.
3.3. The term of office of members of the Expert Council is 5 (Five) years from the date of formation. Members of the Expert Council may be re-elected to the Expert Council an unlimited number of times.
3.4. Members of the Expert Council may be members of the Union that meet the requirements of the current legislation of the Russian Federation and the additional requirements of the Union for members of the Expert Council.
3.5. The Expert Council is headed by the Chairman of the Expert Council.
3.6. The Chairman of the Expert Council and the Deputy Chairman of the Expert Council are approved by the Council of the Union from among the members of the Expert Council.
3.7. The Chairman of the Expert Council appoints the Secretary of the Expert Council from among the members of the Expert Council.
3.8. Identification of the fact that a member of the Expert Council does not comply with the requirements of the Law on Valuation Activities, these Regulations, is the basis for the application of a disciplinary measure in the manner prescribed by the Law on Valuation Activities, acts of the authorized federal body exercising the functions of legal regulation of valuation activities, other regulatory legal acts of the Russian Federation Federation, internal documents of the Union.

4. PRESIDIUM OF THE EXPERT COUNCIL

4.1. The Presidium of the Expert Council (hereinafter - the Presidium) is a collegial working body of the Expert Council.
4.2. The competence of the Presidium includes:
- development and submission for consideration by the Council of the Union of draft documents on the activities of the Expert Council;
- making a decision to conduct unscheduled inspection a member of the Expert Council who does not meet the requirements of the Law on Valuation Activities, these Regulations, in accordance with the procedure established by the current legislation of the Russian Federation, regulatory legal acts of the Russian Federation, internal documents of the Union;
- temporary suspension of members of the Expert Council from conducting examinations of assessment reports in case of detection of violations in their activities;
- consideration of appeals against expert opinions signed by members of the Expert Council;
- other issues stipulated by the legislation of the Russian Federation, the Federal Valuation Standards, other regulatory legal acts of the Russian Federation, as well as internal documents of the Union.
4.3. The Presidium is formed by the Council of the Union from among the members of the Expert Council for a period equal to the term of office of the Expert Council. The number of members of the Presidium of the Expert Council is determined by the Council of the Union.
4.4. The Presidium is headed by the Chairman of the Expert Council. The Chairman conducts the meetings of the Presidium, and in case of his absence, the meetings of the Presidium are chaired by the Deputy Chairman of the Expert Council.
4.5. The Presidium of the Expert Council meets as needed.
4.6. Only members of the Presidium, the secretary of the Expert Council and persons invited by the Chairman of the Expert Council participate in meetings of the Presidium of the Expert Council.
4.7. A member of the Presidium of the Expert Council may participate in the meeting of the Presidium in person or through his representative. Representative in without fail must be a member of the Presidium of the Expert Council, and his right to represent interests must be confirmed by a notarized power of attorney.
4.8. The meeting of the Presidium of the Expert Council is competent if more than half of the members of the Presidium are present.
4.9. Decisions of the Presidium of the Expert Council are taken by a simple majority of votes of the members of the Presidium present at the meeting.

5. MEETINGS OF THE EXPERT COUNCIL

5.1. Meetings of the Expert Council are held as necessary, at the initiative of the Chairman of the Expert Council or the governing bodies of the Union.
5.2. Members of the Expert Council, as well as consultants and other persons involved in its work, take part in the meetings of the Expert Council.
5.3. A member of the Expert Council may participate in the meeting of the Expert Council in person or through his representative. The representative must necessarily be a member of the Expert Council, and his right to represent interests must be confirmed by a notarized power of attorney.
5.4. Decisions of the Expert Council are made by a simple majority vote of the members of the Expert Council present at the meeting.

6. RIGHTS, DUTIES AND RESPONSIBILITIES OF MEMBERS OF THE EXPERT COUNCIL

6.1. Members of the Expert Council, if they are involved as experts for the examination of assessment reports, are obliged to conduct such an examination or justify the refusal to conduct it.
6.2. Members of the Expert Council are obliged to:
- comply with the requirements of the legislation in the field of valuation activities, the Procedure for the examination of the Union's valuation reports, these Regulations and other internal documents of the Union;
- take part in the activities of the Expert Council, including meetings of the Expert Council;
- fulfill the instructions of the Chairman of the Expert Council and his Deputy within their powers, including conducting an examination of assessment reports, as well as providing members of the Union and other persons with clarifications on issues related to the examination of assessment reports;
- testify in court on the basis of an expert examination on the basis of a court ruling;
- refuse to conduct an examination of the assessment report in case of occurrence (including at the stage of the examination) of circumstances that prevent an objective examination of the assessment report, as well as in case of insufficient professional qualifications;
- ensure the safety of documents received from the customer for the examination of the assessment report and third parties during the examination, in accordance with the Procedure for the examination of the Union's assessment reports;
- conduct a full study of the materials provided, give an objective and reasonable expert opinion on the issues raised;
- indicate in the expert opinion the rationale for the conclusion based on the results of the examination of the assessment report, confirming the conclusion made;
- give explanations on issues related to the examination, and on the expert opinion;
- notify executive bodies Union on the facts of exerting influence on it by any persons in order to influence the conclusion (conclusions) contained (contained) in the expert opinion;
- observe the confidentiality of information that became known to him in connection with the examination of the assessment report, except for cases provided for by the legislation of the Russian Federation;
- comply with other requirements stipulated by the current legislation of the Russian Federation.
6.3. Members of the Expert Council have the right to:
- get acquainted with the materials related to the subject of the examination, write out the necessary information from them or make copies;
- request from the customer of the examination and third parties the information necessary for the examination of the assessment report;
- notify the appraiser before the transfer of the expert opinion to the customer about the results of the examination of the assessment report signed by him, if this does not contradict the terms of the agreement for the examination;
- declare the need to involve other experts in the examination;
- appeal in the manner prescribed by the legislation of the Russian Federation, actions that violate the rights of a member of the Expert Council;
- carry out other actions stipulated by the legislation of the Russian Federation, the Federal Valuation Standards, other regulatory legal acts of the Russian Federation and internal documents of the Association.
6.4. Members of the Expert Council are not entitled to:
- carry out an examination of assessment reports if activity as an expert is suspended by decision of the Council of the Union in the manner prescribed by the current legislation of the Russian Federation, regulatory legal acts of the Russian Federation, internal documents of the Union;
- enter into personal contacts with persons interested in the results of the examination on issues related to the conduct of the examination, casting doubt on his disinterest in its results;
- use information that became known during the examination of assessment reports for personal purposes;
- perform other actions, the prohibition of which is provided for by the legislation of the Russian Federation in the field of valuation activities and internal documents of the Union.
6.5. Actions (inaction) of an expert or experts of the Union during the examination of the report, as well as the results of the examination, can be appealed by interested parties to the Union in the manner and within the time limits established by the authorized federal body exercising the functions of legal regulation of valuation activities, or challenged in court .
6.6. It is not allowed to influence the expert of the Union on the part of the body or person on whose initiative the examination is carried out, the appraisers who participated in the preparation of the assessment report, judges, as well as any bodies, organizations, associations and other persons interested in the outcome of the examination.
6.7. The Union, having compensated for the losses caused to the customer who concluded the contract for the valuation, or property damage caused to third parties by the actions (inaction) of the appraiser or appraisers as a result of a violation of requirements established by the court, arbitration court in accordance with the established jurisdiction, arbitration court federal standards assessment, standards and rules for the assessment activities of the Union, in the event of a positive expert opinion prepared and approved in the manner prescribed by internal documents, has the right of recourse to the expert (experts) who signed (signed) the specified expert opinion.

7. PROCEDURE FOR AMENDING THE REGULATION ON THE EXPERT COUNCIL

7.1. Amendments to these Regulations are made in accordance with the current legislation of the Russian Federation and internal documents of the Union.

8. FINAL PROVISIONS

8.1. Issues not regulated by these Regulations are resolved in the manner prescribed by the legislation of the Russian Federation and internal documents of the Union.

The participants analyzed the types of judges and the features of communication with different types, touched on the topic emotional intelligence court lawyer, worked out the skills to increase resistance to negative emotions and aggression, performed a number of exercises to increase confidence and regulate the emotional background of the process.

Alexander Alyoshin, Chairman of the Board of the Non-Profit Partnership “Board of Auditors, Experts and Specialists”, discussed with the participants of the session the topic “Interrogation of a forensic expert. Substantiation of the position of the expert, work with the case materials”, revealing important aspects of the interrogation and interaction of the forensic expert with the investigation in order to obtain additional objects of research, and also spoke about the development of the methodology of forensic financial and economic expertise.

Of great interest to the audience was the speech of a lawyer with 25 years of experience, who specializes in defense in criminal cases of an economic orientation, Ph.D. Konstantin Shutov. In 2015, he led a high-profile case against the Urzhum distillery, which is interesting because several defendants in the case, including appraisers who had been in the SIZO for over a year, were fully acquitted. Konstantin Shutov told the audience about the basics, the specifics of the profession of a lawyer, about the fundamental concepts of the theory of law.

The audience presented their research papers and discussed the directions of future master's theses.

At the end of the educational session, Vladimir Petrenko, partner of SROO Expert Council, head of the legal advice office of the Bar Association of the Moscow Region, played a business game on the trial, in which a real trial was simulated with a preliminary distribution of roles between the participants.

A new level of game, aimed at participants in criminal trials, proved to be more complex than the games usually held at the training of experts in the Master's program "Examination of Evaluation Reports".

December 10 at the PRUE Congress Center G.V. Plekhanov hosted the Sixth All-Russian Forum of Appraisers. The annual meeting, timed to coincide with the Appraiser's Day, brought together hundreds of participants from all over Russia. The discussion was attended by Irina Mikhailovna Filippova, Deputy Director of the Department of Financial and Banking Activities and Investment Development of the Ministry of Economic Development of the Russian Federation and Aleksey Sergeevich Bunkin, Director of the Federal Resource Center for Management Training.

President of the Association A.V. Kaminsky illuminatedthe current situation with the qualification examination. According to federal law No. 172-FZ of 06/02/16, all members of the SROO before April 1, 2018 are required to receive a qualification certificate confirming the passing of the qualification exam.

In fact, professionals who stood at the origins of the industry are required to pass the exam on a par with those who are just starting their professional path. According to the speaker, the situation is similar to that as if academicians were forced to take the Unified State Examination, and if they scored less than school graduates, they would be deprived of their title.

The President of the Association noted that the issue of the exam concerns not only members of the appraisal community, which numbers about 22,000 Appraisers. About 100,000 jobs have been created, taking into account related specialists in the appraisal field.

A significant problem lies in the extremely low intensity of qualexamen intake. On the this moment about 600 Assessors passed the qualification exam, which is no more than 3% of their total number. At the same time, the quantitypreliminary applications for the organization of the qualification exam in the constituent entities of the Russian Federation exceeded 9,000! According to A.V. Kaminsky, with such an organization, more than 80% of Appraisers, mostly regional, will not have the physical opportunity to pass the exam before the deadline and, as a result, will be forced to leave the profession. In turn, this will lead to an increase in the cost of valuation services for the population and a deterioration in the economic microclimate for business.

The speaker drew attention to the delay in the start of the exam for more than 8 months. The exam was supposed to start from the beginning of 2017 so that appraisers entering the SROO in 2017, in accordance with 172-FZ, could have a qualification certificate by 07/01/2017. The first exam was held on August 21, and the first qualattest was issued only on September 13. In fact, an action of civil disobedience is now being carried out, since none of the SROO excludes appraisers who do not meet the requirements of 172-FZ by having a qualification certificate. A.V. Kaminsky stressed the need to improve the procedure and content of the qualification exam: “What is it? Are we watching Agile at the state level? Or is it unprofessionalism on the scale of industry management?”

According to the President of the Association, it is necessary to postpone the exam date from 07/01/2017 and 04/01/2018 to 01/01/2019. This measure will allow developing systematic proposals for amending the legislation, incl. to the profile order of the Ministry of Economic Development No. 257 on the procedure for conducting the exam, as well as to prepare the infrastructure for taking the exam in the regions.

LLC Expert Council organized a series of educational and discussion events in various regions for the Association Self-Regulatory Organization of Appraisers Expert Council. The issues of professional valuation activity in its various manifestations were discussed: changes in legislation, topical issues of real estate valuation, safety of the Appraiser and preparation for the qualification exam. Ready-made cases and non-standard situations that Appraisers faced in their professional activities were also analyzed.

1. A series of seminars "Actual issues of valuation activities." Head of the Committee for regional development Association Sergei Gorev held a series of educational events: April 20 in Penza, May 4 at Ufa, 25 May at Saratov, June 6 at Vologda and 21 June at Stavropol. The seminar participants received detailed information about the latest legislative changes, as well as answers to topical issues of real estate valuation. More than 130 people took part in the events - members of various SROOs, heads of appraisal companies, representatives of the banking sector and public institutions. A distinctive feature of the events was the "question-answer" session, in which the participants had the opportunity to get answers to questions that concern them. 2. The indicated tariffs and terms for the examination of assessment reports are minimal and increase depending on the complexity of the examination (composition, quantitative and quality characteristics and the complexity of the object of assessment, the total amount of work, etc.).

For neighboring real estate objects and land plots, a reduction factor of 0.33 is applied to the second and subsequent objects of assessment relative to the regional tariff. In this case, the object with the maximum area is taken as the base site.
- When examining a corrected version of the valuation report, the appearance of which is due to a change in the valuation date, a reduction factor of 0.7 from the regional tariff is applied.

Entry into the SRO is possible in 2 days. The list of documents required for entry is indicated on the website (list of documents, application, questionnaire, consent to the processing of personal data).

The contribution to the compensation fund is 30,000 rubles.

Quarterly membership fee - 0 rubles for:

Persons joining in 2016 who voluntarily terminated their membership in another self-regulatory organization of appraisers no more than 3 months before joining NP "SROOO "ES" (the benefit is provided for 4 quarters, including the quarter in which the entry is made);

Persons joining in 2016 and who received a certificate of education in the field of assessment activities at a partner educational institution during the period of the agreement between educational institution and Partnership (the benefit is provided for 4 quarters, including the quarter in which the entry is made).

The following categories of members of the Partnership who do not carry out valuation activities: (state and municipal employees; persons whose main place of work is legal entities, which do not enter into valuation contracts as executors, including: banks, Insurance companies, educational institutions; persons on maternity leave or parental leave; disabled persons (more than 3 months).

Preferential 50% quarterly membership fee (1,000 rubles) for those joining after November 12, 2015 and who received a certificate of education in the field of appraisal activity not earlier than one year before the date of joining NP "SROO" ES "(the benefit is provided for 4 quarter, including the quarter in which entry is made).

For managers of appraisal companies and appraisers with more than 5 years of experience - individual conditions.

For all others, the quarterly membership fee is 2,000 rubles.

For appraisers transferring to the Partnership from other SROO and having a certificate in the direction / areas of valuation activities of another SROO, a simplified certification procedure is provided for in NP "SROO" ES ".

From November 01, 2013, the civil liability of each member of the Partnership is insured for 300,000 rubles at the expense of the Partnership. Please note that in order to join the Partnership, insurance must be issued by a member of the Partnership on their own (insurance is needed for entry, the Partnership cannot issue insurance to those who are not yet a member of the Partnership).
